鍾耀華代表律師戴啟思發言：法庭只需考慮，他只是雨傘運動中的每一個人

下文是代表鍾耀華的資深大律師戴啟思在法庭上的發言，由Melody收集、翻譯。

判刑簡記

鍾耀華(第七被告)是廿六歲大學畢業生。

法庭知道，他從沒被定罪的記錄。

法庭知道他在2014年9月做了什麼。他當時要待在前線和台上，是因為他的其他學生領袖朋友已剛被捕。他的言論和行動已被錄在警察的鏡頭中，並在五年後的法庭中被仔細的剖驗過了。

鍾耀華不想法庭考慮他的個人背景。

他希望法庭只需考慮，他是數千位，在添美道及附近街道聚集、想要表達對人大「八三一決定」深感不滿的香港市民的其中一人。他就是每個人(An Everyman)。

鍾耀華只是他們其中一人。鍾耀華可能是任何人的兒子、任何女人的弟兄。除了那份追尋民主理想的堅持之外，這個人並沒有其他可供辨認的特徵。

因此，他不想作任何特別陳詞。他接受自己行為帶來的後果，並會承受任何由法庭判定、與定罪合比例的刑罰。

他把即將判下的刑罰，視之為他直面政治不公義必須付出的代價。而這個政治不公義，昭然持久、直至今日依然如是，且毫不見改善的徵兆。

正如奧賽羅，他可以說：

「當你們報導這些不幸的時候，請你們照實說我，不需徇私迴護。」

至於判刑的有關法律原則，彭耀鴻資深大律師及麥高義資深大律師，已說得很清楚了。

鍾耀華除了不想法庭考慮判社會服務令之外，沒有其他補充。

Sentencing Note

Eason Chung (7th Defendant) (“EC”) is a 26-year-old university graduate.

Court knows from antecedents that he has no previous convictions.

Court knows what he did on those days in September 2014. He was in the fore front, on the stage because a number of his fellow student leaders had just been arrested. His words and actions were all recorded on police cameras for dissection in this Court five years later.

EC does not wish this Court to consider his personal circumstances.

He wants to be considered as a representative type of the thousands of HK citizens that assembled in Tin Mei Avenue and the adjacent streets in order to express their profound disagreement with the decision of the SCNPC on 31 August 2014. An Everyman.

A representative type. A person who could easily be another man’s son, another woman’s brother. Someone with no special identifying traits or characteristics save that commitment to a democratic ideal.

He therefore makes no special plea. He accepts responsibility for his actions and will submit to whatever sentence that is proportionate to the offence that the court may pass on him.

He regards the sentence that will be passed on him as the price he needs to pay to confront what he considers is a manifest and lasting political injustice which endures until this day and shows no sign of going away.

Like Othello, he can say:

“When you shall these unlucky deeds relate, Speak of me as I am. Nothing extenuate…”

The relevant principles for sentencing in cases like this have been canvassed by RPSC and GMSC.

Nothing to add save that EC does not wish to be considered as a candidate for a Community Service Order.
